OPay Executives Risk Jail Over Alleged Contempt of Court Orders

Six senior officials of OPay Digital Services Limited are facing possible committal proceedings after Union Bank of Nigeria Plc filed a contempt application before the Federal High Court in Lagos, citing alleged disobedience to subsisting court orders.

The suit, marked FHC/L/CS/629/2025, lists the company’s Managing Director, Gotring Dauda Wutrika, alongside five directors—Wang Dan, Wen Mingxuan, Duyao Huang Simon, Ozoemena Chijioke, and Abass Rashidat Motunrayo—as respondents in the proceedings.

The application, filed through a Form 49 notice, asks the court to compel the executives to show cause why they should not be committed to prison for alleged non-compliance. It is predicated on provisions of the Sheriff and Civil Process Act and the Judgment Enforcement Procedure Rules.

According to court filings, Union Bank is seeking orders that could lead to the detention of the executives if they are found to have failed to comply with earlier directives. These include preservatory and disclosure orders issued on March 26, 2025, as well as a reversal order contained in a judgment delivered on April 15, 2025.

The bank contends that the court had directed OPay and other financial institutions to restrict accounts linked to disputed transactions and provide details of recovered funds via an affidavit of compliance. It alleges that OPay did not fully comply with these directives, including failure to disclose relevant account information or reverse funds as ordered.

Union Bank maintains that the named executives, as principal officers of the company, are responsible for the alleged non-compliance, describing it as a deliberate attempt to frustrate enforcement of the court’s orders.

Industry observers say the case highlights growing concerns around regulatory compliance in Nigeria’s fintech space, with calls for stronger oversight by the Central Bank of Nigeria.

As of the time of filing, Justice Deinde Dipeolu of the Federal High Court in Lagos has yet to fix a date for hearing the contempt application
